Making & Receiving Call for Businesss


Most of the people find it difficult to make business phone calls in a foreign language. Therefore, in order to make an effective phone call, you must prepare ahead. This will save you time and frustration. Remember that your voice at the end of the line will be the first impression of you. Thus, you need to conduct yourself in a professional manner when making business phone calls.

Preparing for the business call:

ü  Gather all the information and suppliers you might need for the call:
·         The number and the full name of the person you need to speak to
·         Have a calendar, pen and paper at hand
·         Have your personal information at hand: phone number and address to reach you at, etc.


ü  Make sure you are in a quiet and comfortable environment.
This means to turn off the TV, music devices and any other distractions; children and babies should be out of the room when you are making a business call.

ü  Think about what you need to accomplish with this call.
Use notes (‘talking points’) to guide you through the facts and details you want to mention. This may be your only chance to get your point across.

Making the business call:
A business call has three main stages: introduction, middle bulk and an ending summary of the call.

·         
·         Introduce yourself or/and remind the person you are calling of your identity at the beginning of the call.
·         Express gratitude.
Always thank the potential client for allowing you a few moments in his/her busy day. (“I want to thank you for taking my call. This will only involve a moment of your time so you can get back to your busy schedule”).
·         Make sure that the person you are calling is fully available to talk.
If not, try to schedule an appointment for you to call back again.

·         State the purpose of your call.
Be clear and to the point. Do not allow the conversation to go into meaningless chatter.

·         It is important to ask the other person to repeat what you are saying.
In this way you will make sure that he/she fully understands what the conversation is about.

·         Summarise the important points of the conversation and stress on each other’s responsibilities.

·         End the call in a pleasant manner. Thank once again the other person for his/her time. Set an appointment for another call if it is needed, and wish him/her a good day.

              


Things you must keep in mind when making a business call in English:

  •  It is important to use the right level of formality.

If you are too formal, then the person might find it difficult to feel comfortable when she/he talks to you. Then again, if you are too informal, the person could think that you are rude.
  •    It is important to show politeness. Always use please and thank you or thanks very much

whenever you ask for, or receive, help or information. Use words like would, could, may, please, etc. toshow politeness. It is alright to use more informal English, such as okay, bye, no problem, as long as theoverall tone of the conversation is polite.
  •       If you call native speakers in English, you might find it difficult to understand them. The business people tend to speakvery quickly on the phone so you will probably need to slow them down:

o Immediately ask the person to speak slowly.
o    Repeat each piece of information, such name or telephone number or any important data, as the person speaks. Then you automatically slow the speaker down.
o     Do not say you have understood the person if you have not. Ask him/her to repeat until you haveunderstood. Also you can ask the speaker to rephrase it or you can simply say: “I am sorry, do youmean….(what you have understood)”

Why Making Small Talk Matters

Small talk is often seen as meaningless conversation motivated by social politeness: It lacks meaning and value, but you do it because that’s the proper thing. Well, I couldn’t disagree more with this idea.
In my definition, small talk is conversation on safe and somewhat superficial subjects (the weather, the news, the hottest movies or the latest fashion), but it is notmeaningless conversation.
Personally, I’ve learned to stay away from meaningless conversation. If I don’t enjoy it and don’t find significance in it, I do one of two things: I change the subject or I eject. Other than the topic, there is nothing small about small talk and this is why knowing how to make small talk matters as a people skill.
Before anything else, you need to realize that if you struggle with making small talk, it’s to a large extent a confidence issue. People who are confident in social interactions are naturally able to make small talk and connect with others.
So one way or another, you’ll need to get this handled. My conversation confidence presentation will provide you a solid foundation for this. 

Keep It Meaningful





Making small talk makes a lot of sense with people you’ve just met. Imagine asking a person you know for 30 seconds: “So, how’s you sex life?” That is waaay too intrusive! Small talk on the other hand provides a method to ease into the discussion.
When I make small talk, the subjects may be superficial for comfort, but they’re subjects I care about and I approach in straightforward manner, staying away from clichés. This way, I make the discussion meaningful for me and frequently, as a result, for the other person.
Even if I’ll chat with a person I’ve just met about the weather, I’ll make the conversation meaningful. For example, if it’s winter I’ll mention how I don’t like the cold weather, how it probably has something to do with the fact I was born in mid-summer and how I can’t wait for the summer and the sunny beach.
Focus on what is interesting as a topic and on what is real within you. You’ll make the talk fun even though you keep it small.

Have a Life

It’s easy to make small talk when you have a lot of things to chat about. One key realization I had as a social confidence coach is that people who know how to make small talk well have a rich inner and especially outer life.
Conversation is for them just a matter of expressing that. It’s much harder to make small talk well when all you do is work a repetitive job or play on the computer all day.
A rich lifestyle creates content and it helps you engage others. If you don’t have one, it’s time to create it: read, travel, try new things, take on various hobbies, do some charity work and of course, socialize. Not only that this will help your conversations, but it will make your whole life a lot more rewarding as well.

Care about the Vibe More Than About the Topic
A conversation is much more than an exchange of facts and ideas. It is an exchange of energy. What many people miss is that when you know how to make small talk, it means you can create a positive exchange of energy.
The topic is just an excuse, so it doesn’t have to be a deep topic. When I’m out with my friends, we’ll spend hours talking about clothes, pubs, scooters or trends. And we’ll have a blast because the vibe of the entire interaction is positive and relaxed.
When you’re making small talk, you want to focus more on being friendly and positive than on picking the right topic or saying the right things. Smile, relax, joke around, be spontaneous and be silly.
Don’t Get Stuck In Small Talk
Last but not least, keep in mind that small talk is not a destination. It’s just a temporary station. If an interaction with a person goes well, do move the conversation to deeper and more personal topics.
You can talk about topics such as family and relationships, career plans, life goals, challenges and so on. You now find yourself in a new land: the land of big talk.
Ultimately, a strong bond between two people is created when they talk about the most meaningful things, in the most meaningful way. Conversation is very much like a journey into a mysterious forest, and a deeper you go in it, the more intriguing it gets.
I believe that knowing how to make small talk is one of the key people skills to master. From there, if you also know how to have charisma and engage others in more intimate conversation, you can get outstanding results with people and you can build a highly fulfilling social life for yourself.

Personal Presentation

First impressions last, there is often no second chance. The way you present yourself, your character, how you look, the language you use, the way you greet the person and the way you talk will all be judged by your prospective employer.
How you speak 
Think about how you come across. Are you being confident or arrogant? Are you surly or too quiet and timid? Do you speak clearly or do you mumble? Most employers are looking for a person who speaks politely and confidently.

What you say 
Your choice of words is vital, do not use slang or swear at all. Answer questions clearly and honestly and don't waffle. Be aware of what you're saying, who you're saying it to and therefore the message that might be conveyed.

Body language 
Be aware of the messages you are communicating by the way you stand, greet a person and generally hold yourself. Stand confidently, shake the hand of the person interviewing you and sit comfortably rather than slouching.

Cultural sensitivities 
It is important you look the person interviewing you in the eye and maintain that eye contact while you talk with them. This shows you have confidence and respect them. However, many people within different cultures have different beliefs. People of indigenous cultures do not make direct eye contact, be aware of these sensitivities and they will be greatly appreciated as a mark of respect for that person.

What we wear 
Think carefully about what clothing to wear. Dress according to the type of job you are applying for. If it is a gardening job you are applying for, don’t go dressed in a tuxedo. But if the job is with an up-market clothing boutique, your favourite tracksuit won’t be the best choice either! The basic rule is to be smart and dress appropriately for the position for which you are applying. Try to see things from the employer's point of view.
If you have body piercings, just be aware that a more conservative employer may not like that stud through your tongue or brow. It is advisable to take out visible body piercings and if you gain the position, then you can check with the employer if it is OK for you to wear piercings/personal jewellery.

Petama, Order letter atau surat pesanan mungkin sebagian dari kamu sudah pernal liat kah surat pesanan itu seperti apa? Menurut teoriya surat pesanan adalah Surat Pesanan adalah surat yang dibuat oleh pembeli yang ditujukan kepada penjual untuk memesan barang-barang yang diinginkan yess exactly Order Letter is a letter of order is a document that confirms the details of a purchase of goods or services from one party to another. It usually includes more information about what you are ordering, like quantity, model number, or color, the payment terms, and the matter in which the products are to be shipped. When the recipient receives this letter, they will process the order and send the merchandise.

Order Letter Definition An “Order” is an expense for the person placing the order and an income for the one getting it. But this is not all. The company that bags the order has to fulfill lot of commitments to ensure that it has a satisfied customer, which can be an individual or another company. Timely delivery of the order, quality of delivery and after sale service – are all part and parcel of getting an order.

An Order Letter is the one that is written by the person/company placing the request of purchase from another company. This letter comes into action only when a detailed study of the desired product has been done in the market and based on promised service, quality and price of the product, a decision for a purchase has been made.

An Order Letter should be drafted very carefully as it needs to pen down all the terms and conditions of the purchase for the benefit of both involved parties. It should have details such as product specifications, quantities, price agreed upon, delivery date, late delivery clauses, etc. It should be addressed to the person responsible for the execution of the order with a copy to the head of department. Since it is totally an official letter it should be typed.

2. INQUIRY LETTER

Inquiry letter adalah sebuah jenis surat permintaan atau permohonan informasi tentang suatu produk, jasa, lowongan pekerjaan atau informasi bisnis lainnya.Pada umumnya fungsi umum dari surat ini adalah untuk merespon suatu periklanan dari sumber-sumber informasi seperti surat kabar, majalah atau media elektronik tentang suatu produk/jasa saat kita tertarik dengan informasih yang diperoleh tersebut.Biasanya suart ini merupakan sebuah langkah awal dalam membangun sebuah bisnis atau kerjasama dari dua pihak, yakni penyedia produk/jasa dan pembeli produk/jasa tersebut.
A document requesting information sent on behalf of an individual or an organisation for their own respective purposes, which can be mutually beneficial to the recipient and the sender.

The term ‘Inquiry’ is same as ‘Enquiry’. The former is more commonly used in U.S. and the latter one is more common in U.K. There are some other terms which represent the letters; these are Letter of Intent, Letter of Interest, Query letter, Prospecting Letter, Pre-proposal Letter and Concept Paper. The term ‘Cover Letter’, ‘Business Letter’, ‘Request Letter’ and ‘Sales Letter’ is also applied to an inquiry letter especially when the objective is same as that of letter for inquiry.

A letter of inquiry serves to facilitate business operations and satisfaction of the sender. Inquiry letters remove any misunderstanding and are time savers, especially when two parties want to reach an understanding. The communication towards this effect resolves the issue without any delay. With relation to it being a ‘Pre-proposal letter’, the inquiry letter is also termed as a ‘Condensed Version of a Proposal’. It is the outcome of the purpose of the letter which highlights the points of a proposal instead of a full-fledged proposal.

On an individual’s basis, these letters are sent to companies that are willing to hire but haven't advertised job openings. It can also be a letter addressed to editor in-charge of a publication proposing certain literary work. It can be a letter from a student who is vying for a seat in a college or a business that provides an internship. So, the objective of an enquiry letter is same but its projections and audiences are different. Same goes for its method of delivery, it can be sent via paper mail or electronic mail.

In this letter, there are some things that are discussed by the provider of the service / product that is the question of the buyers in order to help the buyer itself to find out information about products / services. These things include:

a. The name and type of product

b. Product specification, namely; type, size, quality, capacity and others;
c. The unit price.
d. Discounts;
e. The method of payment from the buyer to the seller;
f. How to delivery of the product from the seller to the buyer, and
g. The ease with which may be obtained by the buyer, such as warranty and others.

Personal Description

Hello guys..How are you? I hope you all is fine. Now i want to post my english assigment from my lecture of “Bahasa Inggris Bisnis” course. i just want to introduce my self and i hope you guys enjoyed of my post. Here we gooo
Firstly my name is Dayana Ika Prameswari, yeah i really love my name. a beautiful name given my parents. You can call me just “day” . i’m born at jakarta on 25 March 1996,yeah im aries gilrls. Now I’m an accounting student in Gunadarma University Depok, hmm i dont know why i choose gundarma to continous my study , that time i have no idea why I chose Accounting since I’m so weak at accounting subject and also I’m not interested of being an accountant, but my parrent always push me to choose major of accounting. while in high school I was majoring science, and actually I prefer a lesson on biology and health sciences, in fact I almost entered medical school at another university. but my mom always advised me to get in accounting, which I know all the reasons parents it is good. so I could’nt do anything. and now thank God I'm comfortable lecture at Gunadarma although a bit exhausting because my distance far away from the campus, and my parents dont agree to ngekos in Depok.
I live with my parents and my brother. My brother is a student at  Pancasila university majoring in tourism, my father was a Marine he was very firm in educating their children, especially about the relligion. a while my mom is only a housewife . He runs his own business in fact. He has a "kos kosan" in my home.  he was very patient  caring for my brother and me. I love her so much. in fact we fighting sometimes. For me, he is the independent woman. I want to be like her one day.
I love everything about makeup and fashion tbh. idk why I fell in love with makeup since I entered college, makeup is an art for me, a lot of people who do not know what the meaning of "woman with makeup" is not fake but how women express themselves in order to look more beautiful, and about fashion for me Like the photographs with ootd, hehe
most people assume I was the innocent girl and “lola”. actually I just wanted to be a good woman does not mischievous like most people, I was a carefree girl but sometimes I was a very sensitive girl. many people who laugh at me now, and I promise I will make people amazed at some time later.

PENYELESAIAN SENGKETA EKONOMI



Pengertian Sengketa
Pengertian sengketa dalam kamus Bahasa Indonesia, berarti pertentangan atau konflik, Konflik berarti adanya oposisi atau pertentangan antara orang-orang, kelompok-kelompok, atau organisasi-organisasi terhadap satu objek permasalahan. 

Senada dengan itu Winardi mengemukakan :
Pertentangan atau konflik yang terjadi antara individu-individu atau kelompok-kelompok yang mempunyai hubungan atau kepentingan yang sama atas suatu objek kepemilikan, yang menimbulkan akibat hukum antara satu dengan yang lain.

Sedangkan menurut Ali Achmad berpendapat :
Sengketa adalah pertentangan antara dua pihak atau lebih yang berawal dari persepsi yang berbeda tentang suatu kepentingan atau hak milik yang dapat menimbulkan akibat hukum bagi keduanya.

Dari kedua pendapat diatas maka dapat dikatakan bahwa sengketa adalah prilaku pertentangan antara dua orang atau lebih yang dapat menimbulkan suatu akibat hukum dan karenanya dapat diberi sangsi hukum bagi salah satu diantara keduanya

Penyelesaian Sengketa Ekonomi
Penyelesaian sengketa secara damai bertujuan untuk mencegah dan mengindarkan kekerasan atau peperangan dalam suatu persengketaan antar negara. Menurut pasal 33 ayat 1 (Perekonomian disusun sebagai usaha bersama berdasar atas asas kekeluargaan) Piagam PBB penyelesaian sengketa dapat ditempuh melalui cara-cara sebagai berikut:
1. Negosiasi (perundingan)
Perundingan merupakan pertukaran pandangan dan usul-usul antara dua pihak untuk menyelesaikan suatu persengketaan, jadi tidak melibatkan pihak ketiga.

2. Enquiry (penyelidikan)
Penyelidikan dilakukan oleh pihak ketiga yang tidak memihak dimaksud untuk mencari fakta.

3. Good offices (jasa-jasa baik)
Pihak ketiga dapat menawarkan jasa-jasa baik jika pihak yang bersengketa tidak dapat menyelesaikan secara langsung persengketaan yang terjadi diantara mereka.
Penyelesaian perkara perdata melalui sistem peradilan:
1. Memberi kesempatan yang tidak adil (unfair), karena lebih memberi kesempatan kepada lembaga-lembaga besar atau orang kaya.
2. Sebaliknya secara tidak wajar menghalangi rakyat biasa (ordinary citizens) untuk perkara di pengadilan.

Tujuan memperkarakan suatu sengketa:
1. adalah untuk menyelesaikan masalah yang konkret dan memuaskan,
2. dan pemecahannya harus cepat (quickly), wajar (fairly) dan murah (inexpensive)

Selain dari pada itu berperkara melalui pengadilan:
1. lama dan sangat formalistik (waste of time and formalistic),
2. biaya tinggi (very expensive),
3. secara umum tidak tanggap (generally unresponsive),
4. kurang memberi kesempatan yang wajar (unfair advantage) bagi yang rakyat biasa.
Sistem Alternatif Yang Dikembangkan
a). Sistem Mediation

Mediasi berarti menengahi atau penyelesaian sengketa melalui penengah (mediator). Dengan demikian sistem mediasi, mencari penyelesaian sengketa melalui mediator (penengah). Dari pengertian di atas, mediasi merupakan salah satu alternatif penyelesaian sengketa sebagai terobosan atas cara-cara penyelesaian tradisional melalui litigation (berperkara di pengadilan). Pada mediasi, para pihak yang bersengketa, datang bersama secara pribadi. Saling berhadapan antara yang satu dengan yang lain. Para pihak berhadapan dengan mediator sebagai pihak ketiga yang netral. Peran dan fungsi mediator, membantu para pihak mencari jalan keluar atas penyelesaian yang mereka sengketakan. Penyelesaian yang hendak diwujudkan dalam mediasi adalah compromise atau kompromi di antara para pihak. Dalam mencari kompromi, mediator memperingatkan, jangan sampai salah satu pihak cenderung untuk mencari kemenangan. Sebab kalau timbul gejala yang seperti itu, para pihak akan terjebak pada yang dikemukakan Joe Macroni Kalau salah satu pihak ingin mencari kemenangan, akan mendorong masing-masing pihak menempuh jalan sendiri (I have may way and you have your way). Akibatnya akan terjadi jalan buntu (there is no the way).

Cara dan sikap yang seperti itu, bertentangan dengan asas mediasi:
1. bertujuan mencapai kompromi yang maksimal,
2. pada kompromi, para pihak sama-sama menang atau win-win,
3. oleh karena itu tidak ada pihak yang kalah atau losing dan tidak ada yang menang mutlak.

Manfaat yang paling mennjol, antara lain:
1. Penyelesaian cepat terwujud (quick). Rata-rata kompromi di antara pihak sudah dapat terwujud dalam satu minggu atau paling lama satu atau dua bulan. Proses pencapaian kompromi, terkadang hanya memerlukan dua atau tiga kali pertemuan di antara pihak yang bersengketa.
2. Biaya Murah (inexpensive). Pada umumnya mediator tidak dibayar. Jika dibayarpun, tidak mahal. Biaya administrasi juga kecil. Tidak perlu didampingi pengacara, meskipun hal itu tidak tertutup kemungkinannya. Itu sebabnya proses mediasi dikatakan tanpa biaya atau nominal cost.
3. Bersifat Rahasia (confidential). Segala sesuatu yang diutarakan para pihak dalam proses pengajuan pendapat yang mereka sampaikan kepada mediator, semuanya bersifat tertutup. Tidak terbuka untuk umum seperti halnya dalam proses pemeriksaan pengadilan (there is no public docket). Juga tidak ada peliputan oleh wartawan (no press coverage).
4. Bersifat Fair dengan Metode Kompromi. Hasil kompromi yang dicapai merupakan penyelesaian yang mereka jalin sendiri, berdasar kepentingan masing-masing tetapi kedua belah pihak sama-sama berpijak di atas landasan prinsip saling memberi keuntungan kepada kedua belah pihak. Mereka tidak terikat mengikuti preseden hukum yang ada. Tidak perlu mengikuti formalitas hukum acara yang dipergunakan pengadilan. Metode penyelesaian bersifat pendekatan mencapai kompromi. Tidak perlu saling menyodorkan pembuktian. Penyelesaian dilakukan secara: (a) informal, (b) fleksibel, (c) memberi kebebasan penuh kepada para pihak mengajukan proposal yang diinginkan.
5. Hubungan kedua belah pihak kooperatif. Dengan mediasi, hubungan para pihak sejak awal sampai masa selanjutnya, dibina diatas dasar hubungan kerjasama (cooperation) dalam menyelesaikan sengketa. Sejak semula para pihak harus melemparkan jauh-jauh sifat dan sikap permusuhan (antagonistic). Lain halnya berperkara di pengadilan. Sejak semula para pihak berada pada dua sisi yang saling berhantam dan bermusuhan. Apabila perkara telah selesai, dendam kesumat terus membara dalam dada mereka.
6. Hasil yang dicapai WIN-WIN. Oleh karena penyelesaian yang diwujudkan berupa kompromi yang disepakati para pihak, kedua belah pihak sama-sama menang. Tidak ada yang kalah (lose) tidak ada yang menang (win), tetapi win-win for the beneficial of all. Lain halnya penyelesaian sengketa melalui pengadilan. Pasti ada yang kalah dan menang. Yang menang merasa berada di atas angin, dan yang kalah merasa terbenam diinjak-injak pengadilan dan pihak yang menang.
7. Tidak Emosional. Oleh karena cara pendekatan penyelesaian diarahkan pada kerjasama untuk mencapai kompromi, masing-masing pihak tidak perlu saling ngotot mempertahankan fakta dan bukti yang mereka miliki. Tidak saling membela dan mempertahankan kebenaran masing-masing. Dengan demikian proses penyelesaian tidak ditunggangi emosi.

b). Sistem Minitrial

Sistem yang lain hampir sama dengan mediasi ialah minitrial. Sistem ini muncul di Amerika pada tahun 1977. Jadi kalau terjadi sengketa antara dua pihak, terutama di bidang bisnis, masing-masing pihak mengajak dan sepakat untuk saling mendengar dan menerima persoalan yang diajukan pihak lain:
1. setelah itu baru mereka mengadakan perundingan (negotiation),
2. sekiranya dari masalah yang diajukan masing-masing ada hal-hal yang dapat diselesaikan, mereka tuangkan dalam satu resolusi (resolution).
c). Sistem Concilition

Konsolidasi (conciliation), dapat diartikan sebagai pendamai atau lembaga pendamai. Bentuk ini sebenarnya mirip dengan apa yang diatur dalam Pasal 131 HIR. Oleh karena itu, pada hakikatnya sistem peradilan Indonesia dapat disebut mirip dengan mix arbitration, yang berarti:
1. pada tahap pertama proses pemeriksaan perkara, majelis hakim bertindak sebagai conciliator atau majelis pendamai,
2. setelah gagal mendamaikan, baru terbuka kewenangan majelis hakim untuk memeriksa dan mengadili perkara dengan jalan menjatuhkan putusan.
Akan tetapi, dalam kenyataan praktek, terutama pada saat sekarang; upaya mendamaikan yang digariskan pasal 131 HIR, hanya dianggap dan diterapkan sebagai formalitas saja. Jarang ditemukan pada saat sekarang penyelesaian sengketa melalui perdamaian di muka hakim.

Lain halnya di negara-negara kawasan Amerika, Eropa, maupun di kawasan Pasific seperti Korea Selatan, Jepang, Hongkong, Taiwan, dan Singapura. Sistem konsiliasi sangat menonjol sebagai alternatif. Mereka cenderung mencari penyelesaian melelui konsiliasi daripada mengajukan ke pengadilan.

Di negara-negara yang dikemukakan di atas, lembaga konsiliasi merupakan rangkaian mata rantai dari sistem penyelesaian sengketa dengan langkah-langkah sebagai berikut:
1. pertama; penyelesaian diajukan dulu pada mediasi
2. kedua; bila mediasi gagal, bisa dicoba mencari penyelesaian melalui minirial
3. ketiga; apabila upaya ini gagal, disepakati untuk mencari penyelesaian melalui kosolidasi,
4. keempat; bila konsiliasi tidak berhasil, baru diajukan ke arbitrase.
Memang, setiap kegagalan pada satu sistem, penyelesaian sengketa dapat langsung diajukan perkaranya ke pengadilan (ordinary court). Misalnya, mediasi gagal. Para pihak langsung mencari penyelesaian melalui proses berperkara di pengadilan. Akan tetapi pada saat sekarang jarang hal itu ditempuh. Mereka lebih suka mencari penyelesaian melalui sistem alternatif, daripada langsung mengajukan ke pengadilan. Jadi di negara-negara yang disebut di atas, benar-benar menempatkan kedudukan dan keberadaan pengadilan sebagai the last resort, bukan lagi sebagai the first resort.

Biasanya lembaga konsiliasi merupakan salah satu bagian kegiatan lembaga arbitrase, arbitrase institusional, bertindak juga sebagai conciliation yang bertindak sebagai conciliator adalah panel yang terdaftar pada Arbitrase Institusional yang bersangkutan:
1. sengketa yang diselesaikan oleh lembaga konsiliasi pada umumnya meliputi sengketa bisnis,
2. hasil penyelesaian yang diambil berbentuk resolution, bukan putusan atau award (verdict),
3. oleh karena itu, hasil penyelesaian yang berbentuk resolusi tidak dapat diminta eksekusi ke pengadilan,
4. dengan demikian, walaupun resolusi memeng itu bersifat binding (mengikat) kepada para pihak, apabila salah satu pihak tidak menaati dengan sukarela tidak dapat diminta eksekusi ke pengadilan. Dalam hal yang seperti itu penyelesaian selanjutnya harus mengajukan gugatan ke pengadilan.

d). Sistem Adjudication

Sistem Adjudication merupakan salah satu alternatif penyelesaian sengketa bisnis yang baru berkembang di beberapa negara. Sistem ini sudah mulai populer di Amerika dan Hongkong.

Secara harafiah, pengertian “ajuddication” adalah putusan. Dan memang demikian halnya. Para pihak yang bersengketa sepakat meminta kepada seseorang untuk menjatuhkan putusan atas sengketa yang timbul diantara mereka:
1. orang yang diminta bertindak dalam adjudication disebut adjudicator
2. dan dia berperan dan berfungsi seolah-olah sebagai HAIM (act as judge),
3. oleh karena itu, dia diberi hak mengambil putusan (give decision).
Pada prinsipnya, sengketa yang diselesaikan melalui sistem adjudication adalah sengketa yang sangat khusus dan kompleks (complicated). Tidak sembarangan orang dapat menyelesaiakan, karena untuk itu diperlukan keahlian yang khusus oleh seorang spesialis profesional. Sengketa konstruksi misalnya. Tidak semua orang dapat menyelesaikan. Diperlukan seorang insinyur profesional. Di Hongkong misalnya. Sengketa mengenai pembangunan lapangan terbang ditempuh melalui lembaga adjudication oleh seorang adjudicator yang benar-benar ahli mengenai kontruksi lapangan terbang.

Proses penyelesaian sengketa meleui sistem ini, sangat sederhana. Apabila timbul sengketa:
1. para pihak membuat kesepakatan penyelesaian melaui adjudication,
2. berdasar persetujuan ini, mereka menunjuk seorang adjudicator yang benar-benar profesional,
3. dalam kesepakatan itu, kedua belah pihak diberi kewenangan (authority) kepada adjudicator untuk mengabil keputusan (decision) yang mengikat kepada kedua belah pihak (binding to each party),
4. sebelum mengambil keputusan, adjudicator dapat meminta informasi dari kedua belah pihak, baik secara terpisah maupun secara bersama-sama.

e). Sistem Arbitrase

Mengenai arbitrase, sudah lama dikenal. Semula dikenal oleh Inggris dan Amerika pada tahun 1779 melaui Jay Treaty. Berdasar data ini, perkembangan arbitrase sebagai salah satu sistem alternatif tempat penyelesaian sengketa, sudah berjalan selam adua abad.Sekarang semua negara di dunia telah memiliki Undang-undang arbitrase.

Di Indonesia ketentuan arbitrase diatur dalam Buku Ketiga RV. Dengan demikian, umurnya sudah terlampau tua, karena RV dikodifikasi pada tahun 1884. Oleh karena itu, aturan yang terdapat didalamnya sudah ketinggalan, jika dibandingkan dengan perkembangan kebutuhan.
Memang banyak persamaan prinsip antara arbitrase dengan sistem alternatif yang lain tadi, seperti:
1. sederhana dan cepat (informal dan quick),
2. prinsip konfidensial,
3. diselesaikan oleh pihak ketiga netral yang memiliki pengetahuan khusus secara profesional.

Namun, demikian, di balik persamaan itu terdapat perbedaan dianggap fundamental, sehingga dunia bisnis lebih cenderung memiliki mediation, minitrial atau adjusdication. 

Perbedaan yang dianggap fundamental, antara lain dapat dikemukakan hal-hal sebagai berikut:
1. Masalah biaya, dianggap sangat mahal (expensive). Biaya yang harus dikeluarkan penyelesaian arbitrase, hampir sama adengan biaya litigasi di pengadilan. Terdapat beberapa komponen biaya yang harus dikeluarkan, sehingga terkadang jauh lebih besar biaya dengan apa yang harus dikeluarkan bila perkara diajukan ke pengadilan. Komponen biaya atrbitrase terdiri dari: 
(a) Biaya administrasi 
(b) Honor arbitrator. 
(c) Biaya transportasi dan akomodasi arbitrator 
(d) Biaya saksi dan ahli. 
Komponen biaya yang seperti itu, tidak ada dalam mediasi atau minitrial. Jika pun ada biaya yang harus dikeluarkan, jauh lebih kecil. Apalagi mediasi, boleh dikatakan tanpa biaya atau nominal cost.

2. Masalah sederhana dan cepat. Memang benar salah satu prinsip pokok penyelesaian sengketa melalui arbitrase adalah informal procedure and can be put in motion quickly. Jadi prinsipnya informal dan cepatI. Tetapi kenyataan yang terjadi adalah lain. Tanpa mengurangi banyaknya sengketa yang diselesaikan arbitrase dalam jangka waktu 60-90 hari, Namun banyak pula penyelesaian yang memakan waktu panjang. Bahkan ada yang bertahun-tahun atau puluhan tahun. Apalagi timbul perbedaan pendapat mengenai penunjukkan arbitrase, Rule yang disepakati atau hukum yang hendak diterapkan (governing law), membuat proses penyelesaian bertambah rumit dan panjang.
Kelebihan tersebut antara lain:
1. Dijamin kerahasiaan sengketa para pihak
2. dapat dihindari kelambatan yang diakibatkan karena prosedural dan administratif;
3. para pihak dapat memilih arbiter yang menurut keyakinannya mempunyai pengetahuan, pengalaman serta latar belakang yang cukup mengenai masalah yang disengketakan, jujur dan adil;
4. para pihak dapat menentukan pilihan hukum untuk menyelesaikan masalahnya serta proses dan tempat penyelenggaraan arbitrase; dan
5. putusan arbitrase merupakan putusan yang mengikat para pihak dan dengan melalui tata cara (prosedur) yang sederhana saja ataupun langsung dapat dilaksanakan.
Secara garis besar dapat dikatakan bahwa penyelesaian sengketa dapat digolongkan dalam 3 (tiga) golongan, yaitu:
1. Penyelesaian sengketa dengan menggunakan negosiasi, baik yang bersifat langsung (negtation simplister) maupun dengan penyertaan pihak ketiga (mediasi dan konsiliasi),
2. Penyelesaian sengketa dengan cara litigasi, baik yang bersifat nasional maupun internasional.
3. Penyelesaian sengketa dengan menggunakan arbitrase, baik yang bersifat ad-hoc yang terlembaga.
Arbitrase secara umum dapat dilakukan dalam penyelesaian sengketa publik maupun perdata, namun dalam perkembangannya arbitrase lebih banyak dipilih untuk menyelesaikan sengketa kontraktual (perdata). 

Sengketa perdata dapat digolongkan menjadi:
1. Quality arbitration, yang menyangkut permasalahan faktual (question of fact) yang dengan sendirinya memerlukan para arbiter dengan kualifikasi teknis yang tinggi.
2. Technical arbitration, yang tidak menyangkut permasalahan faktual, sebagaimana halnya dengan masalah yang timbul dalam dokumen (construction of document) atau aplikasi ketentuan-ketentuan kontrak.
3. Mixed arbitration, sengketa mengenai permasalahan faktual dan hukum (question of fact and law).
